Terms of Use for PassIt

Please read these Terms of Use carefully before using PassIt.
By downloading, accessing or using the PassIt mobile application, You agree to be bound by these Terms. If You do not agree with these Terms, You should not use the Service.
Interpretation and Definitions
Definitions
For the purposes of these Terms of Use:
- Application refers to PassIt, the software program provided by the Company.
- Company (referred to as either "the Company", "We", "Us" or "Our") refers to PassIt.
- Service refers to the Application and any related services provided by PassIt.
- You means the individual accessing or using the Service.
- Account means a registered user account created to access certain parts or features of the Service.
- Premium means paid features, content or functionality available through a subscription or purchase.
Use of the Service
PassIt is an educational study and revision tool designed to help students prepare for ACCA examinations through practice questions, mock exams, progress tracking and related study features.
You agree to use the Service only for lawful purposes and in accordance with these Terms.
You must not use the Service:
- For any unlawful, fraudulent or harmful purpose
- To copy, reproduce, distribute or resell PassIt content without permission
- To attempt to reverse engineer, modify or interfere with the Application
- To abuse, overload or disrupt the Service
- To share account access with multiple users
- To use the Service in a way that infringes the rights of others
Accounts
Some features of PassIt may require You to create an Account.
When creating an Account, You agree to provide accurate and complete information and to keep Your login details secure.
You are responsible for all activity that occurs under Your Account.
If You believe Your Account has been accessed without permission, You should contact Us immediately.
Guest Use
PassIt may allow certain features to be used without creating an Account.
When using the Service as a guest, some data may be stored locally on Your device. Guest data may not be recoverable if the Application is deleted, the device is replaced or local storage is cleared.
Certain features, including cloud synchronisation, premium access, account recovery and subscription restoration, may require an Account.
Subscriptions and Premium Features
PassIt may offer Premium features through paid subscriptions or purchases.
Premium features may include, but are not limited to:
- Access to additional question banks
- Unlimited practice questions
- Unlimited mock exams
- Progress tracking
- Weak topic analysis
- Wrong question review
- Additional papers, features or study tools
Subscription prices, billing periods and available features may vary by country, platform and time.
Subscriptions are processed through Apple, Google or another authorised payment provider. Payment, renewal, cancellation and refund handling are subject to the terms and policies of the relevant payment provider.
Automatic Renewal
If You purchase a subscription, it may renew automatically unless cancelled before the end of the current billing period.
You are responsible for managing or cancelling Your subscription through Your App Store, Google Play or payment provider account settings.
Deleting the Application does not automatically cancel a subscription.
Cancellations and Refunds
Subscription cancellations must be managed through the platform where the purchase was made.
If You purchased through Apple, cancellation and refund requests must be handled through Apple.
If You purchased through Google, cancellation and refund requests must be handled through Google.
PassIt does not control App Store or Google Play refund decisions.
No Guarantee of Exam Results
PassIt is designed to support exam preparation, but We do not guarantee that use of the Service will result in passing any examination.
Your exam performance depends on many factors, including study time, understanding of the syllabus, exam technique, prior knowledge and official exam requirements.
PassIt should be used as a revision aid alongside official ACCA resources and other appropriate study materials.
Educational Content
We aim to provide accurate and useful educational content, but We do not guarantee that all questions, explanations, mock exams or study materials will be error-free, complete or fully up to date at all times.
We may update, add, remove or modify content at any time to improve the Service.
You should refer to official ACCA materials and guidance for the most up-to-date syllabus, exam rules and requirements.
ACCA Disclaimer
PassIt is an independent study tool developed to help students prepare for ACCA examinations.
While content is designed with reference to the ACCA syllabus, PassIt is not affiliated with, endorsed by, sponsored by or approved by ACCA.
ACCA is a registered trademark of the Association of Chartered Certified Accountants.
Intellectual Property
The Service, including its design, branding, text, questions, explanations, mock exams, software, graphics, logos and other content, is owned by PassIt or its licensors and is protected by intellectual property laws.
You may use the Service for personal, non-commercial study purposes only.
You must not copy, reproduce, distribute, publish, sell, license, modify or create derivative works from any part of the Service without Our written permission.
User Content and Feedback
If You submit feedback, suggestions, comments or other communications to Us, You grant Us permission to use that feedback to improve the Service without obligation to compensate You.
You must not submit content that is unlawful, offensive, harmful, misleading or infringes the rights of others.
Revision Reminders and Notifications
PassIt may allow You to set revision reminders or receive notifications.
Notifications are provided as a convenience only. We do not guarantee that reminders will always be delivered at the exact selected time, as delivery may depend on device settings, operating system rules, internet access and notification permissions.
You may disable notifications through Your device settings.
Account Deletion
You may request deletion of Your Account by contacting Us.
Deleting Your Account may result in loss of saved progress, preferences, account data and access to account-based features.
We may retain certain information where required by law, for legitimate business purposes, or to establish, exercise or defend legal claims.
Privacy
Your use of the Service is also governed by Our Privacy Policy, which explains how We collect, use and protect Your personal data.
You should review the Privacy Policy before using the Service.
Third-Party Services
The Service may contain links to third-party websites, services or platforms.
We are not responsible for the content, policies, availability or practices of third-party services.
Your use of third-party services may be subject to their own terms and privacy policies.
Availability and Changes to the Service
We may update, modify, suspend or discontinue any part of the Service at any time, with or without notice.
We do not guarantee that the Service will always be available, uninterrupted, secure or error-free.
Termination
We may suspend or terminate Your access to the Service if You violate these Terms, misuse the Service, infringe Our rights, or use the Service in a harmful or unlawful way.
Upon termination, Your right to use the Service will stop immediately.

To the maximum extent permitted by applicable law, PassIt shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of data, loss of profits, loss of business, loss of opportunity or exam-related losses arising from or related to Your use of the Service.
The Service is provided on an "as is" and "as available" basis.
Disclaimer of Warranties
We make no warranties or representations that the Service will meet Your expectations, be uninterrupted, be error-free, or guarantee any particular educational, academic or exam outcome.
Your use of the Service is at Your own risk.
Governing Law
These Terms shall be governed by the laws of Ireland, without regard to conflict of law principles.
Changes to These Terms
We may update these Terms from time to time.
If We make material changes, We may notify You by posting the updated Terms in the Application or on Our website.
By continuing to use the Service after changes become effective, You agree to the updated Terms.
